It is good to see the Government listening in a consultation to the overwhelming number of people disagreeing with an increase in the court fee for issuing divorce proceedings to £750.
Given that the Government admitted that they were already covering their costs under the current fee of £410, this looks like an attempt to raise funds without thinking about the way in which this would deter people from seeking divorce and potentially leave them trapped in unhappy marriages.
The Government has dropped its proposal to raise the fee for an application to issue a divorce. In its original proposals the Government had envisaged raising the fee from £410 to £750. In doing so, the Ministry of Justice acknowledged that the current fee was already above the estimated costs of these proceedings of £270. Most respondents to the consultation did not agree with the Government's proposal.
