Alton Towers have been fined £5m for the Smiler rollercoaster crash in June 2015.  The Judge found them to be highly culpable and, given the high risk of harm and lack of systems, the offence was found to be a category one offence.  

In particular, the Judge commented that Merlin (owner of Alton Towers) should have learned lessons from previous convictions relating to Warwick Castle (also owned by Merlin) and that the major problem was a lack of rescue plan.  

The Judge did comment that overall,  Merlin did have a good health and safety record.
