Brad and Angelina appear to be about to commence litigation in California regarding the child maintenance payments to be paid between them.
The law in this country is different from California. Child Maintenance payments are determined by the Child Maintenance Service, rather than the court, except in certain specific circumstances, including:-
* The child having costs associated with education
*The child having costs associated with a disability
*The paying parent earning more than the CMS maximum (currently £3,000 per week gross).
*The paying parent living (or working) outside of this jurisdiction.
It is possible for parents to agree the amount of child maintenance payments between them, or in a court order by consent.
