I have been acting on behalf of a father in an international relocation case for nearly a year and am pleased to report that at the recent final hearing, the court made an order in his favour.
Court proceedings in relation to children are always difficult and it's far preferable if parents can agree arrangements and avoid court proceedings but unfortunately in this case, that wasn't possible. Sadly, the parents in this case found it extremely difficult to communicate and this is something the Judge said has got to be improved upon going forward in the best interests of their children.
The law has changed in relation to court applications and now unless there are exceptional circumstances, parties are required to attend at mediation before making an application to the court in the hope that this will encourage agreement and reduce the number of court applications. I think this change in the law is working and it's pleasing to see more couples reaching an agreement.
