Sir James Mumby, President of the Family Division has issued a warning that in number of cases the procedural rules had not been followed and the Courts have processed paperwork which has allowed some divorces which are null and void.
It appears this mainly relates to divorce petitions issued incorrectly where the parties have not been married for a year .This is a necessary pre-requisite to any divorce .I think this shows the danger of the automation of the proceedings and probably reflects the number of people who have been acting without a solicitor .The Court often do not have the resources to properly check paperwork and it is left to Judges later on in the process to notice any errors .This may bring about changes in the way the on line process is developed but in the meantime be aware that even a limited amount of specific legal advice can be well worthwhile .
