Although in this case, the husband, who was claiming financial relief after 20 years had expired from the decree absolute, was unsuccessful, he was able to bring his claim as there was no final order. We always advise clients that they need a final financial order so as to avoid just this.
A v B (No 2)Divorce – Financial provision. An ex-husband's claim for financial provision from his ex-wife was dismissed. The Family Court held that, while the ex-husband was entitled to bring the claim, notwithstanding a delay of more than 20 years since the parties' divorce, the circumstances did not justify any order for financial provision in circumstances where, among other things, the ex-wife had made a significant financial and material contribution to the care of the parties' children throughout their childhood and beyond, and where she had provided additional support to the ex-husband.
