A colleague told me about this article today and the headline shocked me. On reading further the paper reports that an woman has been given permission to serve court proceedings on her former partner regarding the ownership of assets purchased, gifted and owned by them during their relationship.
This case concerns valuable assets and significant wealth. As the couple had never married the law that will is very different in this country than it would have been.
It will be interesting to see this case unfold and if service by WhatsApp or other messaging platforms will start to be allowed in the future for divorce proceedings and other family law disputes.
If you have any queries about this or any other family law issues, please do not hesitate to contact me.
Ordering the fight to be heard by UK judges, Mr Justice Lavander said: "Ms Gray issued the claim form in the present action and obtained an order for alternative service, pursuant to which she served the claim form on Mr Hurley by WhatsApp message. I conclude that Ms Gray was entitled to serve the claim form on Mr Hurley out of the jurisdiction.”
