Since 2020, we have been in discussions with University Hospitals Derby and Burton NHS Foundation Trust regarding an internal investigation carried out by the Trust in 2016. Their internal investigation relates to a vascular surgeon who previously worked at Royal Derby hospital and has since left this particular trust.

We first became aware of the potential negligence of the vascular surgeon (who we are unable to name at present) when a patient contacted Freeths with regards to a claim. We have acted on behalf of this patient who underwent surgery at Royal Derby in 2018, two years after the Trust’s internal investigation into this clinician. Our client’s case was investigated internally by UHDB following receipt of a complaint made by us on our client’s behalf.

Due to the negligence on the part of the vascular surgeon, the Trust proposed to settle the claim and our client received a significant award of damages.

As far as we are aware, the RCS investigation was undertaken in 2016 and a report produced from the Trust. We have on numerous occasions requested sight of the RCS report from the Trust and were initially promised disclosure in 2020. Since then, it has transpired that the Trust are unwilling to provide us with a copy of the RCS report.

We have concerns that there may be more individuals who have been affected by this particular vascular surgeon and have been overlooked as part of the Trust’s internal investigation.
